The CABs (Citizens Advice Bureaux) have recently announced that literally tens of thousands of small and medium-sized businesses are facing legal action from employees who have been refused their statutory rights. These rights mainly relate to permitting employees to take their regular breaks, whist at work, and also paying staff for their paid leave each year.
There are a number of companies that are looking to save money by way of cutting back on breaks and leave entitlement. Excuses are regularly being used so that the employer can worm their way out of adhering to the statutory obligations that are placed upon them in employment law.
The people that are being most affected by these unlawful actions are people who work in jobs such as cleaners, builders, bar and restaurant staff, clerical staff and care home staff. This is even more of a shame for employees in these industries as they already have to suffer some of the lowest rates of pay around: often around the minimum wage.
Although we do fully understand the pressures that are placed on the shoulders of the employers at the moment, this does not excuse the fact that they are breaking the law. Employment law dictates that employees should take a break at certain times for a reason, moreover, all employees are entitled to a minimum of 4 weeks holiday per year and this bill must be met by the employer.
If you have found that your employer has attempted to worm their way out of one of your statutory rights, check with Community Legal Services or the CAB to find out your true entitlement and politely bring the matter toy the attention of your employer.
